تحلیلی بر پژوهش‌های حقوق مالکیت فکری در مؤسسه استنادی و پایش علم و فناوری جهان اسلام: مطالعه هم رخدادی‌واژگان

چکیده

هدف: هدف از پژوهش حاضر تحلیل مطالعات مرتبط با حوزه حقوق مالکیت فکری در ایران است که در پایگاه استنادی علوم جهان اسلام نمایه شده‌اند.
روش شناسی: پژوهش حاضر از نوع مطالعات تحلیل محتوای کمی است که با استفاده از تحلیل هم رخدادی واژگان و تحلیل شبکه های اجتماعی انجام گرفته است. داده‌های مورد نیاز این پژوهش تیرماه 1403 از پایگاه استنادی علوم جهان اسلام استخراج گردید. تعداد کلید واژه‌های نویسندگان در مدارک مورد بررسی 3160 کلید واژه بود. از روش‌های آماری تحلیل خوشه ای و نمودار راهبردی استفاده گردید.
یافته های پژوهش نشان داد که ساختار مفهومی حقوق مالکیت فکری در ایران از 12 خوشه تشکیل شده است. حق مؤلف، موافقت‌نامه تریپس، فن سنجی، نشانه جغرافیایی، حقوق مالکیت ادبی و هنری، مقایسه تطبیقی مالکیت فکری در حقوق ایران و آمریکا، حقوق مالکیت صنعتی تنوع زیستی و دانش سنتی، حقوق مالکیت فکری، ابعاد حقوقی و کیفری مالکیت فکری، حمایت از نرم افزارهای رایانه ای و سرمایه فکری و اجزاء آن.
نتیجه گیری: نتایج نشان داد که مطالعات سنجشی در پژوهش‌های ایران جایگاه خود را پیدا کرده و به بلوغ نسبی رسیده است به طوری که "فن سنجی" به عنوان یکی از خوشه‌های اصلی حوزه حقوق مالکیت فکری شناسایی شده است

Abstract
Purpose: Intellectual property rights deal with laws developed to protect and enforce the rights of creators and owners of inventions, writings, music, designs, and other works known as "intellectual property". This research aimed to analyze the studies related to the field of intellectual property rights in Iran, which are indexed in the ISC database.
Methodology: This research is a type of quantitative content analysis which was conducted co-word analysis and social network analysis. The data needed for this research was extracted from the Islamic World Scientific and Technology Monitoring and Citation Institution (ISC) in 2024. Bibexcel, UCInet, VOSviewer, and SPSS softwares were used for data analysis. Cluster analysis in VOSviewer and strategic diagrams in Excel were employed. The centrality and density scores of the clusters were used to draw a strategic diagram. The average network density score was calculated as 5.605 for centrality and 0.593 for density.
Findings: The research findings showed that the concepts of "intellectual property rights", "patent", and "copyright" are ranked first to third with a frequency of 226, 97, and 78, respectively. The pairs of "intellectual property rights" with "copyright" and the pair of "intellectual property rights" and "patent" have the most co-occurrence. The conceptual structure of intellectual property rights in Iran consists of 12 topic clusters as described below: Copyright, TRIPS agreement, Technometrics, Geographical indication, Literary and artistic property rights, Comparative Studies of Intellectual Property rights (IPR) between Iran and USA, Industrial property rights, Biological diversity and traditional knowledge, Intellectual property rights, Legal and criminal aspects of intellectual property, Protection of computer software and Intellectual capital and its components. Also, emerging concepts and maturity clusters were identified in this research.
Conclusion: The results of the research showed that bibliometric studies have found their place in Iranian research and have reached relative maturity, so that "Technometrics " has been identified as one of the main clusters in the field of intellectual property rights. The results showed that the research in this field in Iran has a wide conceptual and topical richness. Also, the analysis of co-words conducted on intellectual property right research in Iran has provided a clear picture of the research process in this field. The results of this analysis showed that Iranian researchers have focused more on specific issues such as copyright, patent and industrial property rights. Also, this analysis has helped to identify different research clusters and the relationships between them. On the other hand, the formation of 12 research clusters in the field of intellectual property showed the diversity of the investigated thematics. This diversity of clusters indicated the breadth of the field of intellectual property, which has been addressed in various legal, industrial and technological fields. In particular, clusters related to Comparative comparison of intellectual property in Iranian and American law and literary and artistic property rights demonstrated a special attention to commercial and cultural applications of intellectual property. The "Intellectual Property Rights" cluster has been identified as the most central cluster, which indicates the central role of this cluster in the structure of intellectual property research, as well as the importance of this concept as a key concept in all researches in this field. This cluster has had the greatest impact in shaping researches in this field due to its connection with other clusters and coverage of key topics. On the other hand, the "intellectual capital and its components" cluster, have the highest density, indicates the researchers' focus on the concept of intellectual capital and its components. "Intellectual property rights", "support of computer software" and "intellectual capital and its components" clusters have identified as mature and central clusters in intellectual property research. This shows the maturity of Iranian research in these fields and the existence of a core of active researchers in this field, and they will probably be the focus of new research in the future. In general, due to the emergence of some keywords affected by technological developments, it seems that laws and regulations related to intellectual property need to be modified and adapted to technological developments so that these laws are aligned with technological developments. The results of this study showed that although the research area of intellectual property rights has experienced significant growth in recent decades in Iran, there are still some gaps and new opportunities for future research that can lead to a better understanding of the different dimensions of this concept; including research on those subject clusters, such as Biological diversity and traditional knowledge, and Geographical indications, that have received less attention and have not been able to achieve sufficient maturity and development over time.
